Misuse of Drugs Act 1975 · 2026
Still illegal, handled with more discretion
Cannabis is a Class C controlled drug in New Zealand, and the 2020 referendum on legalisation was narrowly lost. Since 2019, police must ask whether charging someone for personal possession is in the public interest, or whether a health approach would work better. Here is what applies in Auckland, as everywhere in the country.
-
Illegal
3 months / $500
Possessing or using a small amount
Police often give a warning or a referral to health support instead of charging you.
-
Illegal
1 year / $500
Pipes, bongs and other utensils
Having anything used to smoke cannabis is a separate offence.
-
Presumed supply
up to 8 years
28 g or more, or 100 joints
From this amount, the law presumes you are dealing. It is up to you to prove you are not.
-
Supply
3 months → 8 years
Giving cannabis, even for free
Giving to an adult is punished like possession. Giving to anyone under 18 counts as dealing.
-
Dealing
8 years
Selling, or offering to sell
Selling any amount is dealing, a serious crime that can go before a jury.
-
Cultivation
7 years
Growing, even one plant
Cultivation is a serious offence. Even having cannabis seeds is illegal (up to 1 year).
-
Drug driving
12 h ban + fine
Driving after using
Random roadside saliva tests since December 2025. Driving while impaired is a criminal offence.
-
Legal
on prescription
Medicinal cannabis
Legal on prescription under the Medicinal Cannabis Scheme since 2020, CBD included. People with a terminal illness also have a legal defence.
No coffee shops, no clubs, no legal market: in New Zealand there is no legal way to buy cannabis for recreational use.
New since December 2025
Roadside saliva tests: what happens
Police can stop any driver at random and test their saliva for THC, meth, MDMA and cocaine. The tests have covered the whole country since July 2026, Auckland included.
- Random stopNo suspicion needed: any driver can be tested, just like a breath test.
- Two saliva testsIf the first test is positive, a second one follows straight away.
- 12 hours off the roadTwo positive tests: you cannot drive for 12 hours. A third sample goes to the lab.
- Lab resultIf confirmed: $200 and 50 demerit points for one drug, $400 and 75 points for two or more.
Refusing the test: $400, 75 demerit points and a 12-hour ban. A prescription does not stop the test: a medical defence can only be claimed afterwards.

Illegal, but often a warning
- Possession: up to 3 months in prison and/or a $500 fine.
- Police must consider a warning or a health referral before charging you.
Look after yourself
Help and harm reduction
- Never drive after using: saliva tests detect recent use.
- Stay away from synthetic cannabinoids ("synnies"): they have caused many deaths in New Zealand.
- Avoid mixing with alcohol: the effects add up.
- Start low and go slow, especially with edibles.
- Never around minors, and never pass it on.
Frequently asked questions
Is weed legal in Auckland?
No. Cannabis is a Class C controlled drug across New Zealand. Possessing it can mean up to 3 months in prison and/or a $500 fine, although police often give a warning or a health referral for a small amount.
Didn't New Zealand vote to legalise cannabis?
It voted on it, and said no. In the 2020 referendum, 50.7% voted against the Cannabis Legalisation and Control Bill, so the law did not change.
How much can I carry?
No amount is allowed. From 28 g, or 100 joints, the law presumes you are dealing and you have to prove you are not.
Can I grow a plant at home?
No. Growing cannabis is cultivation, punishable by up to 7 years in prison. Even having seeds is illegal.
Can I get medicinal cannabis or CBD?
Yes, with a prescription. Under the Medicinal Cannabis Scheme, doctors can prescribe approved cannabis products, including CBD. Talk to your GP.
Can tourists or working-holiday makers buy weed legally in Auckland?
No. New Zealand has no coffee shops and no legal clubs. Buying on the street is illegal and risky, and a drug conviction can put your visa at risk.
